Terms of Service | Viva oral assessment platform

Please read these Terms carefully before using the Viva platform. By accessing or using the platform, you agree to be bound by them. These Terms apply to all users: instructors, institution administrators, and students, at institutions globally.

1. About Viva

Viva is an AI-powered oral-assessment platform. Students submit their work, then have a short spoken conversation with an AI about it. The AI produces a suggested grade and feedback. An instructor reviews everything and sets the official grade of record. The AI never makes the final grading decision; your instructor does.

2. Eligibility and Accounts

Age. Users must be at least 14 years old to create an account. Where an institution enrols younger students, the institution is responsible for any additional consent required under applicable law — for example, COPPA for students under 13 in the US, UK GDPR for students under 13 in the UK, PIPA for students under 14 in South Korea, or equivalent local law elsewhere.

Institutional access. The platform is licensed to institutions. Instructor/administrator access is governed by the Master Service Agreement between your institution and Viva. Student access is provided through your institution's licence.

Accurate information. You agree to provide accurate, current, and complete information when creating an account, and to keep it up to date.

Account security. You are responsible for keeping your login credentials confidential. Do not share your account with anyone. Notify us immediately at legal@vivaproof.com if you suspect unauthorised access.

Institutional responsibility. Your institution is responsible for ensuring its users comply with these Terms.

3. The Assessment Process

How it works. When assigned a Viva assessment, you submit your work and participate in an AI-led oral interview about it. The interview is recorded, transcribed, and used to generate a suggested score and feedback for your instructor.

Instructor review. AI-generated grades are always advisory and never final by themselves. An instructor either reviews each result before release or, per assignment, chooses in advance to release results automatically once grading is complete. No grade is ever set by automated means alone.

Microphone, camera, and browser. The oral interview requires a working microphone and a supported browser. Where your institution has enabled Camera Check, a working camera is also required for that feature; if you are not enrolled in it, you do not need a camera. Viva is not responsible for assessment disruptions caused by your hardware, network, or browser.

Academic integrity. By participating in a Viva assessment, you confirm that the work you submit is your own (or an appropriately attributed collaboration permitted by your institution), and that you are the person participating in the oral interview. Impersonation, unauthorised assistance during the interview, or any other academic dishonesty violates these Terms and your institution's academic integrity policy.

Accessibility. Viva provides accommodation pathways for students with disabilities or additional needs, including extra time, captioning, and first-language options. Contact your instructor or institution's support team to arrange accommodations.

4. Acceptable Use

You agree not to: use the platform unlawfully; impersonate another person during an interview or submit another person's work as your own; manipulate, bias, or deceive the AI assessment system — including, where Camera Check is enabled, by feeding the camera a photograph, recording, or artificial video input, or by arranging for another person to assist off-camera; use automated tools, bots, or scripts to access or extract data; reverse engineer or decompile the platform; upload malware or harmful content; harass or harm other users; access another user's account or data without authorisation; use the platform to train or test a competing AI product; or share your account credentials.

Viva reserves the right to suspend or terminate access for violations, without prior notice where immediate action is necessary. See also our Acceptable Use Policy for detailed conduct rules.

5. Privacy and Data

Privacy Policy. Our Privacy Policy explains how we collect, use, and protect personal data — including a dedicated plain-language section for students and families — and governs our data practices.

Institutional controller. For students and instructors, your institution is the data controller and Viva is the data processor. Your institution's own privacy policy also applies.

Student data. Viva processes student data only as directed by your institution and in accordance with our Data Processing Agreement. We do not sell student data or use it for advertising.

Voice recording. Oral interviews are recorded and stored until 90 days after your grade is released to support instructor review, then permanently deleted — sooner on request once grading is complete, unless the interview is part of an open grade review or integrity investigation, in which case it's retained until that's resolved. If your institution places a documented, time-limited retention hold on a class (for example written research consent or an open grade dispute), the recording is kept until the hold ends and then deleted. Your instructor has access to the recording within the Viva platform for assessment purposes. Students may request access to their recording through their institution.

Voice ID (voiceprint) — optional. Voice ID is an optional identity-verification feature offered to every student during onboarding, independent of your institution's own settings — it is not something your institution switches on or off. You'll be asked for your own separate, explicit consent on a standalone screen at the point your voice sample is captured — this consent is never bundled with account creation, the Terms, or any other agreement. You may decline or withdraw consent at any time without penalty; your institution will then assess you another way. In Illinois, this feature is not offered until your institution has signed a specific written agreement (a BIPA Rider) with Viva, as required by Illinois law.

Camera Check (video-integrity) — optional. Camera Check is a separate optional feature, controlled by your institution and disabled by default, requiring its own separate consent on its own screen. Where enabled, your camera checks simple presence/attention signals during the interview — whether a face is present, whether your gaze is on the screen. Analysis happens locally in your browser; live video is never transmitted to or stored by Viva. Viva keeps only derived signals and a small number of flagged still images, deleted on the same schedule as your interview record. It does not identify you from your face, does not create a faceprint, and is never used to infer your emotions or mood, or to grade you. You may decline or withdraw consent at any time without penalty.

6. Intellectual Property

The platform, including all software, AI models, scoring methodologies, user interfaces, and documentation, is owned by Viva. You may not copy, modify, distribute, sell, or sublicense any part of it. You retain ownership of the work you submit; submitting it grants Viva a limited licence to process it for providing the assessment service. Feedback you provide about the platform may be used by Viva without restriction or compensation.

7. Disclaimers and Limitation of Liability

The platform is provided “as is.” AI grades are advisory; the instructor is the final decision-maker on all grades. Voice ID and Camera Check signals are advisory academic-integrity indicators only; an instructor reviews every flag, and no grade or integrity finding is determined by these signals alone.

Limitation. To the fullest extent permitted by applicable law, Viva's total liability to any user for any claim arising out of these Terms shall not exceed the total fees paid by the user's institution for that user's access in the preceding 12 months.

Excluded losses. Viva is not liable for loss of data (beyond our data processing obligations), loss of marks or academic standing resulting from a user's own conduct, or indirect, consequential, or punitive damages.

Nothing in these Terms excludes liability for death or personal injury caused by negligence or fraud, or any liability that cannot be excluded by applicable law — nor does it waive any private right of action applicable law confers on you directly and that cannot be waived by contract, including under applicable biometric privacy law.

8. Changes to These Terms

We will notify your institution of material changes by email and in-platform notice at least 30 days before they take effect.

9. Governing Law and Disputes

For institutional customers, these Terms are governed by the law specified in that institution's Master Service Agreement with Viva. For individual users with disputes not covered by an institutional contract, disputes will be resolved by binding arbitration under the rules of a mutually agreed arbitration body in the applicable jurisdiction, or in a court of competent jurisdiction if arbitration is not enforceable where you live.

연령. 계정을 만들려면 14세 이상이어야 합니다. 기관이 그보다 어린 학생을 등록하는 경우, 관련 법이 요구하는 추가 동의(예: 미국 13세 미만 학생에 대한 COPPA, 영국 13세 미만 학생에 대한 영국 GDPR, 한국 14세 미만 학생에 대한 개인정보보호법, 그 밖의 지역에서는 이에 상응하는 현지 법)를 받을 책임은 기관에 있습니다.

기관을 통한 이용. 플랫폼은 기관에 라이선스됩니다. 교수자/관리자의 이용은 소속 기관과 Viva 사이의 기본 서비스 계약(MSA)에 따릅니다. 학생의 이용은 소속 기관의 라이선스를 통해 제공됩니다.

기관의 책임. 소속 이용자가 본 약관을 준수하도록 할 책임은 기관에 있습니다.

3. 평가 절차

작동 방식. Viva 평가가 배정되면 과제를 제출하고 그에 관한 AI 주도 구술 인터뷰에 참여합니다. 인터뷰는 녹음·전사되며, 교수자를 위한 제안 점수와 피드백을 생성하는 데 사용됩니다.

교수자 검토. AI가 생성한 성적은 항상 참고용이며 그 자체로 최종 성적이 되지 않습니다. 교수자는 각 결과를 공개 전에 검토하거나, 과제별로 채점이 끝나면 결과를 자동으로 공개하도록 미리 선택할 수 있습니다. 어떤 성적도 자동화된 수단만으로 확정되지 않습니다.

마이크, 카메라, 브라우저. 구술 인터뷰에는 작동하는 마이크와 지원되는 브라우저가 필요합니다. 기관이 카메라 확인을 켠 경우 그 기능을 위해 작동하는 카메라도 필요하며, 그 기능에 등록되지 않았다면 카메라는 필요하지 않습니다. Viva는 이용자의 하드웨어, 네트워크, 브라우저로 인한 평가 중단에 책임지지 않습니다.

학업 진실성. Viva 평가에 참여함으로써 제출하는 과제가 본인의 것(또는 기관이 허용한 적절히 표기된 협업물)이고, 구술 인터뷰에 참여하는 사람이 본인임을 확인하는 것입니다. 대리 응시, 인터뷰 중 허용되지 않은 도움, 그 밖의 학업 부정행위는 본 약관과 소속 기관의 학업 진실성 정책에 위배됩니다.

접근성. Viva는 장애가 있거나 추가 지원이 필요한 학생을 위해 추가 시간, 자막, 모국어 옵션 등 편의 지원 경로를 제공합니다. 편의 지원을 마련하려면 담당 교수자나 기관의 지원 부서에 문의해 주세요.

4. 이용 규칙

다음 행위를 하지 않는 데 동의합니다: 플랫폼의 불법적 이용, 인터뷰에서 타인을 사칭하거나 타인의 과제를 본인 것으로 제출하는 행위, AI 평가 시스템을 조작·편향·기만하는 행위(카메라 확인이 켜진 경우 카메라에 사진, 녹화 영상, 인공 영상을 입력하거나 화면 밖에서 다른 사람의 도움을 받도록 하는 행위 포함), 자동화 도구·봇·스크립트로 데이터에 접근하거나 추출하는 행위, 플랫폼의 역설계나 디컴파일, 악성코드나 유해 콘텐츠 업로드, 다른 이용자에 대한 괴롭힘이나 가해, 권한 없이 다른 이용자의 계정이나 데이터에 접근하는 행위, 경쟁 AI 제품의 학습이나 테스트에 플랫폼을 이용하는 행위, 계정 정보 공유.

Viva는 위반 시 이용을 정지하거나 종료할 권리를 보유하며, 즉각적인 조치가 필요한 경우 사전 통지 없이 할 수 있습니다. 자세한 행위 규칙은 이용 정책을 참고해 주세요.

5. 개인정보와 데이터

개인정보처리방침. 개인정보처리방침은 저희가 개인정보를 어떻게 수집, 이용, 보호하는지(학생과 가족을 위한 쉬운 말 안내 포함) 설명하며, 저희의 데이터 처리 관행을 규율합니다.

기관이 컨트롤러. 학생과 교수자에 대해서는 소속 기관이 데이터 컨트롤러이고 Viva는 데이터 프로세서입니다. 소속 기관의 개인정보처리방침도 함께 적용됩니다.

학생 데이터. Viva는 소속 기관의 지시와 데이터 처리 계약에 따라서만 학생 데이터를 처리합니다. 학생 데이터를 판매하거나 광고에 이용하지 않습니다.

음성 녹음. 구술 인터뷰는 교수자 검토를 돕기 위해 녹음되어 성적 공개 후 90일까지 보관된 뒤 영구 삭제됩니다. 채점이 끝나면 요청 시 더 일찍 삭제되지만, 해당 인터뷰가 진행 중인 성적 검토나 무결성 조사의 대상이라면 그 절차가 끝날 때까지 보관됩니다. 기관이 서면 근거(예: 서면 연구 동의, 진행 중인 성적 이의)를 남기고 기한을 정해 한 수업에 보관 연장을 설정한 경우에는 그 기한까지 보관된 뒤 삭제됩니다. 담당 교수자는 평가 목적으로 Viva 플랫폼 안에서 녹음에 접근할 수 있습니다. 학생은 소속 기관을 통해 본인의 녹음에 대한 접근을 요청할 수 있습니다.

음성 ID(성문), 선택 사항. 음성 ID는 온보딩 과정에서 모든 학생에게 제공되는 선택적 신원 확인 기능이며, 기관의 설정과 무관합니다. 기관이 켜거나 끄는 기능이 아닙니다. 음성 샘플을 채취하는 시점에 별도의 독립된 화면에서 본인의 별도 명시적 동의를 요청받으며, 이 동의는 계정 생성, 본 약관, 그 밖의 어떤 약정과도 묶이지 않습니다. 언제든 불이익 없이 거절하거나 동의를 철회할 수 있으며, 그 경우 기관은 다른 방식으로 평가합니다. 일리노이주에서는 기관이 일리노이 법에 따라 Viva와 특정 서면 계약(BIPA 부속 계약)을 체결하기 전까지 이 기능이 제공되지 않습니다.

카메라 확인(영상 무결성), 선택 사항. 카메라 확인은 기관이 관리하는 별도의 선택 기능으로 기본적으로 꺼져 있으며, 자체 화면에서 별도의 동의를 받아야 합니다. 켜진 경우 인터뷰 중 카메라가 얼굴이 있는지, 시선이 화면에 있는지 같은 단순한 현존·주의 신호를 확인합니다. 분석은 브라우저 안에서 로컬로 이루어지며, 실시간 영상은 Viva로 전송되거나 Viva에 저장되지 않습니다. 플랫폼(모든 소프트웨어, AI 모델, 채점 방법론, 사용자 인터페이스, 문서 포함)은 Viva의 소유입니다. 그 어떤 부분도 복제, 수정, 배포, 판매, 재라이선스할 수 없습니다. 제출한 과제물의 소유권은 이용자에게 있으며, 제출함으로써 평가 서비스 제공을 위해 이를 처리할 제한적 라이선스를 Viva에 부여합니다. 플랫폼에 대해 제공한 피드백은 Viva가 제한이나 보상 없이 이용할 수 있습니다.

7. 면책과 책임 제한

플랫폼은 "있는 그대로" 제공됩니다. AI 성적은 참고용이며, 모든 성적의 최종 결정권자는 교수자입니다. 음성 ID와 카메라 확인 신호는 참고용 학업 진실성 지표일 뿐이며, 교수자가 모든 표시를 검토하고, 어떤 성적이나 진실성 판정도 이 신호만으로 결정되지 않습니다.

책임 한도. 관련 법이 허용하는 최대 범위에서, 본 약관과 관련해 발생하는 청구에 대한 Viva의 이용자에 대한 총책임은 직전 12개월 동안 해당 이용자의 이용을 위해 소속 기관이 지급한 총요금을 초과하지 않습니다.

본 약관의 어떤 내용도 과실이나 사기로 인한 사망 또는 인신 상해에 대한 책임, 또는 관련 법상 배제할 수 없는 책임을 배제하지 않으며, 관련 법(생체정보 프라이버시법 포함)이 이용자에게 직접 부여하고 계약으로 포기할 수 없는 사적 소권도 포기하게 하지 않습니다.

8. 약관의 변경

중대한 변경 사항은 발효 최소 30일 전에 이메일과 플랫폼 내 공지로 소속 기관에 알려 드립니다.

9. 준거법과 분쟁

기관 고객의 경우, 본 약관은 해당 기관과 Viva 사이의 기본 서비스 계약에 명시된 법률의 적용을 받습니다. 기관 계약이 적용되지 않는 개인 이용자의 분쟁은 해당 관할권에서 상호 합의한 중재 기관의 규칙에 따른 구속력 있는 중재로, 또는 거주지에서 중재가 집행될 수 없는 경우 관할 법원에서 해결합니다.
