Acceptable Use Policy | Viva oral assessment platform

This Acceptable Use Policy ("AUP") sets out the rules governing use of the Viva platform by all users: instructors, administrators, and students. By using the platform, you agree to comply with this AUP. This AUP is incorporated by reference into the Master Service Agreement and Terms of Service.

1. Purpose of the Platform

Viva is designed to help institutions verify that students genuinely understand the work they submit. It is to be used solely for this educational purpose. Any other use is outside the scope of this AUP and the platform licence.

2. Permitted Uses

The platform may be used for: conducting AI-powered oral assessments of students' understanding of submitted work; creating, managing, and reviewing assignments and rubrics; reviewing AI-suggested grades and setting official grades of record; listening to a student's oral interview recording within the platform (instructors, for grading review and integrity assessment, for as long as the recording is retained under the Privacy Policy); managing student accommodation profiles; exporting assessment data for institutional records; and participating in assessment as a student.

3. Rules for Institutions and Instructors

Institutions and instructors must not:

(a) Use the platform for any purpose other than educational assessment within the institution
(b) Share platform access or credentials with unauthorised users outside the institution
(c) Use the platform as a disciplinary or surveillance tool beyond its stated assessment purpose
(d) Download, screen-record, extract, or share a student's audio interview recording or any still image captured by Camera Check outside the platform, or use either for any purpose other than grading review and academic integrity assessment
(e) Configure the platform in a way that discriminates against students on the basis of protected characteristics in ways not required by a legitimate competence standard
(f) Use student data extracted from the platform for any purpose not permitted under the Data Processing Agreement
(g) Attempt to circumvent or manipulate the AI assessment system to produce predetermined outcomes
(h) Enable Camera Check for any student before the separate biometric consent required by applicable law has been obtained on the platform's standalone consent screen for that feature — including a guardian's consent where the student is below the age at which they can consent for themselves. Voice ID is offered directly to students during onboarding and is not something an institution enables; the one exception is Illinois, where an institution must sign a BIPA Rider before Voice ID is offered to its students at all.
(i) Penalise, disadvantage, or deny assessment to a student who declines, or withdraws consent to, Voice ID or Camera Check. An alternative assessment method must be provided without detriment — meaning it must not be more time-consuming, difficult, or burdensome for the student than the declined feature would have been
(j) Use Voice ID or Camera Check signals, still images, or any output derived from them for grading, for automated adverse decisions, for identifying a student from their face, or for inferring a student's emotions, mood, or affective state
(k) Use the platform in a way that violates the institution's own policies, applicable law, or this AUP

4. Rules for Students

Students must not: have another person complete their oral interview on their behalf; receive real-time assistance from another person, AI tool, or notes during the live interview unless explicitly permitted by their institution; attempt to manipulate, deceive, or “game” the AI interview system; share their login credentials with any other person; record, screen-capture, or reproduce interview questions, rubrics, or assessment output without prior written permission from their institution and Viva; use automated tools, bots, or AI systems to interact with the platform on their behalf; where Camera Check is enabled, feed the camera a photograph, recording, virtual-camera stream, or other artificial video input, or arrange for another person to remain off-camera to assist, in order to defeat or mislead the check; upload harmful, abusive, or offensive content or content that violates applicable law; or attempt to access another student's account, data, or results.

5. Rules for All Users

All users are prohibited from: reverse engineering, decompiling, or extracting source code or AI model parameters; using automated tools to scrape, crawl, or bulk-extract data; introducing malware or other harmful code; attempting unauthorised access to any part of the platform, its infrastructure, or another user's data; harassing, threatening, or abusing other users; using the platform to develop, train, or benchmark competing AI products; or violating any applicable law or regulation in connection with use of the platform.

6. Institutional Responsibility

Institutions are responsible for: communicating this AUP to all users before they use the platform; enforcing compliance among their users; investigating and taking appropriate action in response to suspected violations; obtaining and documenting the separate biometric consent required before Camera Check is enabled for any student — captured on the platform's standalone consent screen for that feature, not folded into general onboarding acceptance (Voice ID consent is captured directly by Viva from each student during onboarding and does not require separate action from the institution, except in Illinois, where the institution must sign a BIPA Rider before Voice ID is offered to its students at all); and notifying Viva promptly at legal@vivaproof.com of any known or suspected violations involving the platform or student data.

7. Consequences of Violations

Viva reserves the right to: suspend or terminate the account of any user who violates this AUP, without prior notice where immediate action is necessary; remove or restrict access to violating content; notify the institution of a violation; disable Camera Check for an institution, immediately and without notice, where Viva has reason to believe it has been enabled without the required consent, or suspend Voice ID access for an institution's students where Viva has reason to believe the required consent — or, in Illinois, the required BIPA Rider — is not in place; and co-operate with law enforcement where required. Violations by students may also be referred to the institution's academic integrity process.

9. Changes

Institutions will be notified of material changes at least 30 days before they take effect.

3. 기관과 교수자의 규칙

기관과 교수자는 다음 행위를 해서는 안 됩니다:

(a) 기관 내 교육 평가 이외의 목적으로 플랫폼을 사용하는 것
(b) 기관 외부의 권한 없는 이용자와 플랫폼 접근 권한이나 계정 정보를 공유하는 것
(c) 명시된 평가 목적을 넘어 징계나 감시 도구로 플랫폼을 사용하는 것
(d) 학생의 인터뷰 음성 녹음이나 카메라 확인이 촬영한 정지 이미지를 플랫폼 밖으로 다운로드, 화면 녹화, 추출, 공유하거나, 채점 검토와 학업 진실성 평가 이외의 목적으로 사용하는 것
(e) 정당한 역량 기준상 필요하지 않은 방식으로 보호되는 특성을 이유로 학생을 차별하도록 플랫폼을 구성하는 것
(f) 플랫폼에서 추출한 학생 데이터를 데이터 처리 계약에서 허용하지 않는 목적으로 사용하는 것
(g) 미리 정해진 결과를 만들어 내기 위해 AI 평가 시스템을 우회하거나 조작하려는 것
(h) 관련 법이 요구하는 별도의 생체정보 동의를 해당 기능의 독립된 동의 화면에서 받기 전에 어떤 학생에 대해서든 카메라 확인을 켜는 것. 학생이 스스로 동의할 수 있는 연령 미만인 경우 보호자의 동의도 포함됩니다. 음성 ID는 온보딩 과정에서 학생에게 직접 제공되며 기관이 켜는 기능이 아닙니다. 유일한 예외는 일리노이주로, 기관이 BIPA 부속 계약에 서명하기 전까지는 그 기관의 학생에게 음성 ID가 아예 제공되지 않습니다.
(i) 음성 ID나 카메라 확인을 거절하거나 동의를 철회한 학생에게 불이익을 주거나, 불리하게 대우하거나, 평가를 거부하는 것. 불이익 없는 대체 평가 방법을 제공해야 하며, 이는 거절한 기능보다 학생에게 더 많은 시간이 들거나, 더 어렵거나, 더 부담스러워서는 안 된다는 뜻입니다.
(j) 음성 ID나 카메라 확인의 신호, 정지 이미지, 그로부터 도출된 결과물을 채점, 자동화된 불리한 결정, 얼굴로 학생을 식별하는 것, 학생의 감정·기분·정서 상태 추론에 사용하는 것
(k) 기관 자체 정책, 관련 법, 본 AUP에 위배되는 방식으로 플랫폼을 사용하는 것

4. 학생의 규칙

학생은 다음 행위를 해서는 안 됩니다: 다른 사람에게 본인의 구술 인터뷰를 대신 보게 하는 것, 기관이 명시적으로 허용하지 않는 한 실시간 인터뷰 중 다른 사람, AI 도구, 메모의 도움을 받는 것, AI 인터뷰 시스템을 조작하거나 기만하거나 "꼼수"를 쓰려는 것, 로그인 정보를 다른 사람과 공유하는 것, 기관과 Viva의 사전 서면 허가 없이 인터뷰 질문, 루브릭, 평가 결과물을 녹화·화면 캡처·복제하는 것, 자동화 도구, 봇, AI 시스템으로 본인 대신 플랫폼과 상호작용하게 하는 것, 카메라 확인이 켜진 경우 확인을 무력화하거나 오도하기 위해 카메라에 사진, 녹화 영상, 가상 카메라 스트림, 그 밖의 인공 영상을 입력하거나 다른 사람이 화면 밖에서 도움을 주도록 하는 것, 유해하거나 모욕적이거나 불쾌한 콘텐츠 또는 관련 법에 위배되는 콘텐츠를 업로드하는 것, 다른 학생의 계정, 데이터, 결과에 접근하려는 것.

5. 모든 이용자의 규칙

모든 이용자에게 다음 행위가 금지됩니다: 소스 코드나 AI 모델 파라미터의 역설계, 디컴파일, 추출. 자동화 도구로 데이터를 스크래핑, 크롤링, 대량 추출하는 것. 악성코드나 그 밖의 유해한 코드를 유입시키는 것. 플랫폼의 어떤 부분, 그 인프라, 다른 이용자의 데이터에 무단 접근을 시도하는 것. 다른 이용자를 괴롭히거나 위협하거나 학대하는 것. 경쟁 AI 제품의 개발, 학습, 벤치마크에 플랫폼을 사용하는 것. 플랫폼 이용과 관련해 관련 법령을 위반하는 것.

6. 기관의 책임

기관은 다음에 책임이 있습니다: 이용자가 플랫폼을 사용하기 전에 모든 이용자에게 본 AUP를 알리는 것. 소속 이용자의 준수를 관리하는 것. 위반 의심 사례를 조사하고 적절한 조치를 취하는 것. 어떤 학생에 대해서든 카메라 확인을 켜기 전에 필요한 별도의 생체정보 동의를 받아 기록하는 것. 이 동의는 일반 온보딩 수락에 포함시키지 않고 해당 기능의 독립된 동의 화면에서 받아야 합니다(음성 ID 동의는 온보딩 과정에서 Viva가 각 학생에게 직접 받으므로 기관의 별도 조치가 필요하지 않습니다. 다만 일리노이주에서는 기관이 BIPA 부속 계약에 서명하기 전까지 그 기관의 학생에게 음성 ID가 아예 제공되지 않습니다). 플랫폼이나 학생 데이터와 관련된 위반 사실이나 의심 사례를 legal@vivaproof.com 으로 즉시 Viva에 알리는 것.

7. 위반 시 조치

Viva는 다음 권리를 보유합니다: 본 AUP를 위반한 이용자의 계정을 정지하거나 종료하는 것(즉각적인 조치가 필요한 경우 사전 통지 없이). 위반 콘텐츠를 삭제하거나 접근을 제한하는 것. 위반 사실을 기관에 알리는 것. 필요한 동의 없이 카메라 확인이 켜졌다고 볼 이유가 있는 경우 통지 없이 즉시 해당 기관의 카메라 확인을 끄는 것, 또는 필요한 동의(일리노이주의 경우 필요한 BIPA 부속 계약)가 갖춰지지 않았다고 볼 이유가 있는 경우 해당 기관 학생의 음성 ID 이용을 중단하는 것. 필요한 경우 법 집행 기관에 협조하는 것. 학생의 위반은 기관의 학업 진실성 절차에 회부될 수도 있습니다.
