Acceptable Use Policy

This Acceptable Use Policy ("AUP") sets out the rules governing use of the Viva platform by all users: teachers, administrators, and students. By using the platform, you agree to comply with this AUP.

This AUP is incorporated by reference into the Master Service Agreement and Terms of Service.

1. Purpose of the Platform

Viva is designed to help schools verify that students genuinely understand the work they submit. It is to be used solely for this educational purpose. Any other use is outside the scope of this AUP and the platform licence.

2. Permitted Uses

The platform may be used for:

  • Conducting AI-powered oral assessments of students' understanding of submitted work
  • Creating, managing, and reviewing assignments and assessment rubrics
  • Reviewing AI-suggested grades and setting official grades of record
  • Listening to the audio recording of a student's oral interview within the platform (for teachers, for grading review and academic integrity assessment, for up to 30 days)
  • Managing student accommodation profiles for disability or accessibility needs
  • Exporting assessment data (transcripts, grades, metadata) for institutional records
  • Participating in assessment as a student (submitting work and completing the oral interview)

3. Rules for Institutions and Teachers

Institutions and teachers must not:

  • (a) Use the platform for any purpose other than educational assessment within the institution
  • (b) Share platform access or credentials with unauthorised users outside the institution
  • (c) Use the platform as a disciplinary or surveillance tool beyond its stated assessment purpose
  • (d) Download, screen-record, extract, or share a student's audio interview recording outside the platform, or use a recording for any purpose other than grading review and academic integrity assessment
  • (e) Configure the platform in a way that discriminates against students on the basis of protected characteristics (disability, race, sex, religion, etc.) in ways not required by a legitimate competence standard
  • (f) Use student data extracted from the platform for any purpose not permitted under the Data Processing Agreement
  • (g) Attempt to circumvent or manipulate the AI assessment system to produce predetermined outcomes
  • (h) Use the platform in a way that violates the institution's own policies, applicable law, or these Terms

4. Rules for Students

Students must not:

  • (a) Have another person complete their oral interview on their behalf (impersonation)
  • (b) Receive real-time assistance from another person, AI tool, or notes during the live interview, unless explicitly permitted by their school
  • (c) Attempt to manipulate, deceive, or "game" the AI interview system
  • (d) Share their login credentials with any other person
  • (e) Record, screen-capture, or otherwise reproduce interview questions, rubrics, or assessment system output without prior written permission from their school and Viva
  • (f) Use automated tools, bots, or AI systems to interact with the platform on their behalf
  • (g) Upload content that is harmful, abusive, offensive, or violates applicable law
  • (h) Attempt to access another student's account, data, or assessment results

5. Rules for All Users

All users are prohibited from:

  • (a) Attempting to reverse engineer, decompile, or extract source code or AI model parameters from the platform
  • (b) Using automated tools to scrape, crawl, or extract data in bulk
  • (c) Introducing malware, viruses, or other harmful code
  • (d) Attempting to gain unauthorised access to any part of the platform, its infrastructure, or another user's data
  • (e) Harassing, threatening, or abusing other users
  • (f) Using the platform to develop, train, or benchmark competing AI products or services
  • (g) Violating any applicable law or regulation in connection with use of the platform

6. Institutional Responsibility

Schools are responsible for:

  • Communicating this AUP to all users (teachers and students) before they use the platform
  • Enforcing compliance among their users
  • Investigating and taking appropriate action in response to suspected violations
  • Notifying Viva promptly at legal@vivaproof.com of any known or suspected violations that involve the platform or student data

7. Consequences of Violations

Viva reserves the right to:

  • Suspend or terminate the account of any user who violates this AUP, without prior notice where immediate action is necessary
  • Remove or restrict access to content that violates this AUP
  • Notify the institution of a user's AUP violation
  • Co-operate with law enforcement where required

Violations by students may also be referred to the institution's academic integrity process.

9. Changes

Viva may update this AUP from time to time. Institutions will be notified of material changes at least 30 days before they take effect.
